Dear, Mr. Hodges

I am sure that you receive several questions and requests from a variety of sources each and every day. More than you would like to I am sure. I can’t begin to thank you enough for what you have done for the CMKX shareholders. No matter what eventually happens with this stock we would have been absolutely no where without your tireless efforts and dogged determination. All of us hang on every scrap of info and update that you provide.

To be totally honest some of us (myself) included are concerned with the content of some of your letters / updates. I am not considered to be in the conspiracy camps and some of their accusations for me anyway are troublesome and quite frankly unbelievable. I’m not saying one side is right and the other wrong just that for me I need to be able to rationalize things sufficiently to feel comfortable. I am an admitted skeptic and realist who needs to see it before believing. Some may feel that I am naïve in this regard. So be it.

Having said all of that I have heard / read where people say the connection to the White Hat reports as well as the letters to the President and Queen of England are some sort of secret code or misinformation. The people that come up with this reasoning are obviously troubled as well by the language in these documents.

I guess that I am asking two things. One do you firmly believe in the conspiracy theories that these documents seem to suggest or are they in fact misinformation or some sort of coded message to parties unknown.

Secondly if you look at our situation with CMKX and the Bivens suit in an objective, independent and unemotional way as if you were another attorney not connected to it and you were not a shareholder what would you say our realistic chances are of getting some sort of payment.

I do hope you are not offended by this letter or anything it may suggest. If you choose not to answer I will understand but a response will go a long way with many people in their decision to hold on to hope a little while longer or to just move on and chalk this up to an investment that did not pan out.

Mr. Hodges asked me to thank you for the kind words and to respond to your (really good) email. Thank you for penning one of the better letters we have received, among the many.

Al and I were shareholders long before the law office itself got involved and long before Al brought the Bivens matter forward. During the course of our involvement we (and shareholders who have been paying attention) have received a quite startling education centering on demonstrable, rampant corruption in the market place. When we first encountered CMKM, we didn’t know a naked short or a failure to deliver from a sixteen penny nail. We thought the Federal Reserve was a benevolent and benign government agency looking out for the best interests of the American economy. We have since found out the sordid truth of those matters and are now of the firm conviction that the corruption goes to the top of the food chain. If that suggests to some that we’ve fallen prey to Loony Tune Conspiracy Theories, so be it.

Al has never wavered in his conviction that shareholders will be paid. Finalizing the when and how much however has proven to be time consuming, expensive and frustrating (at least so far) but perseverance furthers, and we will persevere.

In truth, we have been led to believe it to be “over” more than once only to find that one of the moving parts failed to close or stop at the last moment. Believe me, we share shareholder angst and disquietude over the inordinate amount of time this is taking to resolve and so wish we could wave a magic wand to make everything come up roses, now. With the economy in shambles and everything else falling apart, shareholders are looking to CMKM as their last chance to get square and escape the onerous indignity of penury which looms on the horizon for so many. While we believe shareholders will indeed “get (more than) square”, we can’t guarantee it, or for that matter can’t guarantee even that the sun will rise tomorrow, although the odds seem pretty good. My advice to all has always been to put your Certificates in your back pocket and get on with life. No matter where we are or what we are doing when this “hits”, it will forever change our lives and, on the off-chance it never hits, those who have planned for life without CMKM largess will be better insulated and further down their road than those who did nothing else save wait for a check to arrive.

You will please forgive my general responses as opposed to more specific responses to your questions.

As a parting aside, my new favorite definition of reality; “That which when you stop believing in it refuses to go away.”

Dennis. Thanks so much to you and Al for the quick reply. Your words are all one can expect and I hope we can all share the fruits of the hard work that the Hodges's team (those members known and unknown) that have occurred to date and undoubtedly in the future. One thing and I will respect your wishes but can I share your response with other shareholders. It may prevent other emails or letters to you that people are considering. Then again it may encourage adiitional ones who knows?
