Good morning, everyone. First time poster to this board! Great Board!
Has there been any discussion as to what it means if the SEC fails to file their statement today? Does it mean that we won?
I've been thinking recently about IBM's role and how he came to be involved with CMKX. I've read many different thoughts on when and how he met UC.
I've been thinking that it was the SEC that introduced them, and that perhaps IBM is working for the SEC and not really for UC. I'm thinking that during the R. Glenn tenure last year that perhaps he brought the SEC in and made them realized the problem. They also realized they needed help and couldn't clean this up alone. Perhaps they brought IBM in and he put together the plan which has resulted in all that we have seen going on with the resignations, etc. That would explain why IBM knew so little about CMKX at the trial.
The part that doesn't make sense, however, is why would the SEC go through the motions of revoking if they were behind the plan. Well, perhaps because only a few in the SEC know of the plan. Top secret sting.
I can't believe I actually wrote that because I never bought in to the sting idea -- until now.
Just the early morning ramblings of a tired and overworked person, wishing this is the scenario so that I can retire soon! Lana

Lana, I have been wondering the same thing.
Is there a chance they will not respond today....and if so, what could that mean?

If they don't respond today, I'll be even more convinced that IBM is working for the SEC as their client and not ours! It certainly will be a positive regardless of who he works for, however. Lana

based on what others have implied i would say a no-response from the SEC today would be a very good sign since it might suggest cmkx's paperwork has been reviewed by the SEC and we are getting set to go!
on another item, i suspect we will hear from usca in the form of their filing. at least that is what i think ANDY has been suggesting for several days now when he says we could hear from cmkx or any of its JVs any day now. (remember, usca was supposedly set to file a week ago.)

I think it is very plausable that the SEC could have used a cia front to investigate. If the SEC wanted to make this look like business as usual(revocation) to allow the sting to play out, then one would think that a sting operation would require such covert actions. We may never know the whole truth, but it sure is a posibility.

Since we have appealed the Judge's decision to the Commission, they would go ahead and decide the appeal without the additional input from their own counsel. However, their failure to respond would leave questions in the Commission's mind.

if they dont ...they should be revoked!!! That's funny...and true I think. If I remember correctly, there was an article about the SEC not long ago that stated the FACT that the SEC is not even current with their own financials. Hypocrites(sp?)...... - golf
