An oldie.....Dec 27, 2010 Hello All~ I had a friend translate this. He is fluent in English and Italian. It should be easier to read with proper English, for all of us. Here it is as follows: Dear Friends: Last night I was in contact via skype with a very close friend of Al Hodges. She is a very sweet and kind Italian woman, and she tried to explain to me what was going on here without sharing many confidential details. As I think you understand, this story involves so many "powerful" players and adversaries as to become almost unbelievable. Anyway, this is what she said to me: Our payment is imminent. The delay has been due to a continuing and endless series of administrative measures that must be approved world-wide, which makes the identification of an exact payment date uncertain. So, when Bob Hollenegg writes that payment could occur at any time, he is speaking the truth. There are two "Paymasters" that will receive these funds: Cottrell and Tyler, TX. When the payments are announced to the Paymasters, Al Hodges will issue and official statement to all shareholders explaining the details, such as how much, when, and in what manner we will be paid. Payments will be made in several, separate cycles. The first payment we receive will represent $.80 (eighty cents) per share. It is for the delay of payment, which should have been made to us in 2007. The other payments(s) will occur about one month thereafter. The exact amount(s) of these subsequent payment(s) is unknown at this time (or was not conveyed by Mr. Hodges), but is being circulated on the boards in the area of $5 to $6 per share. In response to my inquiry as to how we could get such a huge payout, my friend said that she too was astonished when she heard Al Hodges describe this. But Ex SEC Attorney Hakala told a shareholder in a lengthy phone call the last week of December that there is no money for shareholders ...it was all a scam.
Hopefully that was what she thought when she was involved??

F&P would be one payment lump sum which all would have to sign an NDA before receiving the funds(small payment first $.23 cents per share with NDA attached), breach the NDA requirements loose your settlement funds. The only thing SK can do is sign off on the transfer of certificates and run his NHI shell of a company. What Robert Maheu setup for the bonafide shareholders, and passed on the baton to Mr. Hodges, SK cannot change anything that has already been established for the bonafide shareholders. I have talked to a shareholder who confirmed the information written about Gates is correct. He confirmed the brokers settled. But Gates did not guarantee we would be paid. So it is time for Gates to step up to the plate with what he has as I was also someone who paid him for the information. You guys are funny. I told the reason for delay, many times . Waiting for case to be over. Then cancellation of around 100 billion shares held by culprits. Then release of money. (If it is still available). You may also contact Seahawkswc on Ihub and ask for delay. I don't know him personally. Oldepro knows that I am in touch with Mr Gates. With respect. PS there is more to this saga. Clarification 'Possible release of money' , did not come from Mr Gates. It was from another source , and information came few years back. I don't know, if money is still available or not. Amt told was between $1.20 and $2.40 , plus interest. Nothing more to add. With respect Guys pay attention. A general response regarding the rumor that Phx Gold or anyone else for that matter “caught” Ameritrade. I know just a little bit about market makers and the rules. It was common practice for all brokers to sell share markers to their clients, and I can tell you,at that time I owned a nice percentage of those shares. The brokers were allowed to pool these markers for a specified time period. When it was required through CEDE they would have to purchase those shares from the market place. In this case Ameritrade bought from a broker that was pushing boatloads on the market,Nevwest. They do not care where these shares come from,as long as they are cleared through the seller, a fellow broker and CEDE. That cert remained in street name,aka Ameritrade for their clients who had markers in their accounts. People call this selling short,but it’s not. They didn’t sell shares in hopes the security would go under,they wouldn’t jeopardize their billion dollar business for the amount of shares sold at the price of the security at that time. I know factually that some of my shares (markers) were included in the covered shares. You can call it naked shorting if you want,but the broker in question committed no crime and was never given any punishments. They carried the security to closing, the closing that is afforded brokers amongst themselves. Regardless of numbers matching, which was merely Ameritrade putting out to market that specific number of shares they needed, and a Nevwest client selling that exact number to fulfill the request. There is no proof at all with regards to selling short and no reason for that particular broker to gamble on this or any other fractional or sub,sub,sub penny stock. The remedy for not covering within the proper time period Is certainly not mega billions of dollars. Too often today, as we see everyday in juror decisions, there is no longer a beyond reasonable doubt thought process. There is though, a rush to judgement based upon the wildest of circumstantial evidence. Which is the case here. Having said the above, there is more to this than meets the eyes. There has been for some while a need to cancel shares sold from Helen Bagley and friends firms. If these shares are shares sold to Ameritrade or any other broker late to the table, shares from Deli dog, and a whole plethora of unknowing individuals then Ameritrade is on the hook to make the Shareholders whole,which would be to pay either the price of the security at SHs purchase point or to pay the higher amount of the share price going forward. In this situation the security never appreciated but went under. The end of trial should bring forward a cancellation of shares. The unknowing purchasers included a lot of decent people. I believe Hodges purchased some of these shares as well. I also believe there has been a battle going on behind the scenes to get these shares included in any making whole of the shareholder base. But what do I know? I don’t have a source,it’s circumstantial.

A general response regarding the rumor that pootsa knows what he/she is talking about. Well there you go… pootsa explains everything! I guess we should all just ignore stuff like this… When questioned by Leslie A Hakala and Marshall S Sprung (SEC enforcement attorney's) during his deposition (File No. LA-03028-A) at the Securities and Exchange Commission, Pacific Region office in Los Angeles, California on Tuesday January 24, 2006 with regards to what evidence he was shown that led him to believe that there was a naked short in CMKM Diamonds Attorney Donald J. Stoecklein stated that there was an expert brought in from Oregon and that after his analysis his position was that there was a 14 to 1 short position in this stock, meaning that for every 1 legal share issued there were 13 others that were not! When questioned... why did he believe this person? Mr. Stoecklein stated... “The man is very credible. He spent 25 years chasing shorts. He is an expert assisting a law firm down in Texas right now on a short position, and some major litigation. So why would I believe KPMG that their audit is good? They’re an expert in what they do. It’s the same issue to me.”
That’s only about 9 trillion naked shorted, sorry, I mean counterfeit shares that magically appeared out of thin air… nothing to be concerned about there, obviously that expert with 25 years experience from KPMG, only one of the largest auditors on the planet, was high on drugs at the time and all of those counterfeit shares were imaginary! And this is of no concern… The “Jefferies Letter”… this letter, dated May 6th 2005, is the response from Cathleen Shine, Deputy General Counsel for the securities clearing house Jefferies & Company, to a request from Ms. Anne Dansard Glowacki of the National Association of Securities Dealers (NASD, now FINRA) concerning Jefferies’ failure to report certain trades in CMKM Diamonds in March of 2004. In it, it explains, how they (Jefferies) cleared trades for 2 of their customers totaling nearly 112 billion shares of CMKM Diamonds “Ex-Clearing” and now needed guidance from the NASD on how to remedy the situation. “Ex-Clearing” refers to trades that are cleared outside of a clearing house and are therefore not reported to the public and the market in general. On the same day copies of the letter were forwarded to counsel for CMKM Diamonds and to the SEC who (mistakenly?) provided it as evidence during the CMKM Diamonds administrative hearing... during this hearing SEC attorney Gregory Glynn asked to withdraw it as evidence, Attorney Frizzell objected because it was provided as evidence by the SEC in the first place, Judge Murray sided with Frizzell and ruled it to stay in evidence.
That letter clearly illustrates how billions and even trillions of shares could enter the market unreported… clearly no broker dealers or market makers or regulators involved there! And don’t pay any attention to this document previously available on our website… View Attachment (For clarity the green and yellow highlights and the text at the very bottom were added by the author) Like it says there on the bottom… subtract 703,518,875,000 legal outstanding shares from the 2,581,027,515,064 issued shares and you end up with 1,877,508,640,064 that don’t belong, and that’s only from 3063 of the approximately 50,000 shareholders accounts… do the math! So, please, do not pay any attention to any of the above obviously fabricated evidence… you may just grasp the concept that although Ameritrade may have been innocent (doubtful in my opinion) in the naked shorting, sorry, counterfeiting of CMKM Diamonds there were approximately 100(?) other broker dealers, market makers and clearing houses along with a corrupt SEC and DOJ that were not! That being said pootsa does make some interesting statements… “I know just a little bit about market makers and the rules.” Unfortunately all of those involved didn't follow the rules now did they! “They do not care where these shares come from,as long as they are cleared through the seller, a fellow broker and CEDE” That is correct, unfortunately “THEY” were mostly corrupt so none of them cared were the counterfeit shares came from to settle their books! It’s not like they were going to report each other, remember, they didn't follow the rules! “but the broker in question committed no crime and was never given any punishments.” Oh, and the SEC, DOJ and the FBI are by far the most honest, trustworthy and dedicated to law enforcement organizations in the US Justice System! Hello, follow the news much? “There is no proof at all with regards to selling short” And no one would care if they were just selling short… that’s legal! It’s the naked shorting, sorry, I mean counterfeiting of our stock that we’re concerned with! For proof of that please see above! “Is certainly not mega billions of dollars.” Well without getting into fines, penalties, punitive damages and or possibly RICO charges that could possibly make the original fines, penalties, punitive damages even larger… just covering the possibly 10 trillion naked shorted, sorry, I mean counterfeit shares @ $0.0005 equals $5 billion!
